Do Non Compete Agreements Hold Up In Washington State

That depends. Courts often consider these factors: territorial scope, duration, nature of restricted tasks and consideration – in relation to others. For example, a large geographic area – say an entire state – may be more likely to be applicable if the duration of the restriction is short – say a month. On the other hand, a broad geographical scope associated with a long period of prohibition by a court is rather unenforceable. In examining the size of the space, the courts check the services provided by the employer. As a general rule, the court does not allow any non-competition clause preventing a worker from working in an area where the employer does not make transactions. The Washington Supreme Court also repealed state laws in violation of the contractual clause. To Carlstrom v.
State, a teachers` union claimed that the state had breached the contractual clause by enacting laws that had nullified their previously agreed wage increases. The Tribunal found that the legislation violated the contractual clause by disproportionately affecting previous contractual agreements. Carlstrom v. State, 103 Wash.2d 391, 397 (1985). Not all non-competition prohibitions are practical, reasonable or fair. The Tribunal has the right to decide whether a non-competition clause is appropriate and therefore valid. The following concerns must be taken into account when deciding whether to maintain a non-competition clause: ensure that an employee must earn more than $100,000 in order for a non-compete agreement to be applicable to the employee. The result is moral hazard. The employer has no reason to insist on strict non-competition clauses, since there are no consequences on the use of extended catch clauses; the courts will simply apply the “blue pencil” clause (i.e. rewrite) and apply a more “reasonable” version of it. As noted in the previous question, the length of time considered appropriate is generally analyzed in conjunction with the other factors.
